Important Information - Please Read Before Proceeding: E-mail communication with The Law Offices of Trey Phillips does not create an attorney-client relationship between our firm and you. An attorney-client relationship is created only by written contract after a thorough investigation of a case and acceptance by the attorney. This website is for general information only. This information is not legal advice and should not be relied upon without consulting an attorney of your choice.

HOW SOON CAN YOU COLLECT FOR ME?
Once we have all of the proper paperwork, including a signed agreement, we'll get to work immediately!  We generally attempt to make contact with the debtor by letter first, and if this doesn't work we can file Court documents on your behalf within days.

WILL YOU COMPROMISE MY CLAIM?
We will negotiate within the limits set by our client.  If the client have a very old, difficult to collect case, we may recommend that they attempt to settle the claim for a payment less than the full amount.  While we may discuss potential settlement offers with the other side, we would never commit to a settlement without the prior authorization of the client.

WILL I EVER HAVE TO PAY MORE THAN THE INITIAL COST DEPOSIT?
It depends on the circumstances of each individual case, and the arrangements will all be set in writing before we begin on your case.  In any case we would never incur costs on behalf of the client without their prior approval.

WHAT PERSONAL INVOLVEMENT WILL I HAVE?
As much or as little as you like.  We pride ourselves on our results, and on the satisfaction of our clients.  We will always keep you informed of the progress of your case.  You can expect to receive phone calls and/or letters from us each time there is any activity in your case.

HOW DO YOU DISBURSE PROCEEDS FROM MY COLLECTION?
This again depends upon the facts of each particular case and will be disclosed in writing before any engagement begins.

Options include:

  1. Pay a flat fee and all proceeds are forwarded directly to the client.
  2. Pay my hourly rate and all proceeds are forwarded directly to the client
  3. Pay only the costs, and all proceeds are split according to the contingency arrangement agreed to in writing, and
  4. In some cases we may advance filing fees and retain a certain percentage of proceeds collected after first applying any money collected to out of pocket expenses and/or fees.

WHAT IF YOU CAN'T COLLECT FOR ME?
We will do our best to collect your debts, but sometimes a debtor may have no assets or if we cannot find them, then it may be impossible to collect.  This possiblity will be discussed during our intial consultation and if you have concerns we invite you to bring them up during our intitial consultation.

WHO WILL ANSWER MY ROUTINE QUESTIONS?
Our phones are answered 24 hours per day, and we invite you to call when you have questions.  Most questions can be answered by our staff during normal business hours, if more research is needed to answer your question we will try to return your call within 24 hours.
